I'm unsure how to "legally" hire a subcontractor. Do they need to have their own business basically and I would provide jobs? How does this work?

There are a number of criteria here in Ontario that I think apply to most places, the most crucial being that they must show they operate a business of their own ie, the work you provide to them MUST NOT be their only source of revenue. Obviously there are other criteria like a valid sub contractors agreement, their own insurance , bonding, WSIB, equipment etc. .They must also show that if they have employees that they submit deductions and have their own payroll account with the Canada Revenue Agency. I am sure that I have left a lot out but this post is on the run so other members, please fill in what I have omitted.
